Right of withdrawal

In the event that the stipulation of a purchase contract takes place away from the commercial premises, the sale in question is to be considered subject to Legislative Decree no. 206 of 6/09/2005, which provides for the possibility for the buyer to exercise the right of withdrawal.
This therefore includes remote purchases made by telephone, or via the Internet, whether they are delivered to the home or collected at the company’s headquarters or at a point of presence in the area.

To whom it applies

To natural persons (consumers) who act for purposes that can be considered unrelated to their commercial activity. Purchases made by retailers and companies are therefore excluded from the right of withdrawal. It is excluded, therefore, from the right of withdrawal, who communicates to the supplier his VAT number.

Recess

You have the right to withdraw from the contract within 14 days without giving any reason.
The cancellation period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquire, physical possession of the last asset.
This right consists in the right to return the purchased goods to the seller and the consequent refund of the purchase price.

How to use it

Make sure you have the following data ready and promptly communicate them to Alberello Design:

– our delivery code;
– bank details (IBAN and BIK CODE) to which you want the transfer payment to be made.

1. Send, by registered mail with acknowledgement of receipt, a written and signed declaration of the intention to exercise the right of withdrawal summarizing all the data indicated above and requested (including any authorization to credit the amount to a bank account in the name of a third party), addressing it to our MODO LAB SRL office – Corso Guglielmo Marconi, 2, 10125 Turin TO, Italy.

2. Within the same period of fifteen working days you must return the goods intact and, if packed, with the same packaging used for delivery. The shipment to the sender is at his expense and under his responsibility.

How to make the return shipment

Carefully pack the materials, if possible, with the same packaging used for delivery.
Write down the destination address and the sender on the package.
Send the package to Alberello Design di MODO LAB SRL, Via Sestriere 67, None (TO) 10060.

Processing times transfer transfer payment to the customer

Alberello Design, if the above procedure is carried out correctly and if it ascertains that the product is completely intact in all its parts, will provide within 30 working days of receipt of the goods to credit the customer with the amount (JUDGMENT EC Court of 15/04/2010 – case C511/08).
Attention: we are not responsible for any damage caused during the shipment of return goods by the customer at our warehouse.

Jurisdiction and Jurisdiction

Any dispute relating to the application, execution, interpretation and violation of purchase contracts stipulated “online” through the website www.alberellodesign.com is subject to Italian jurisdiction; these general conditions are reported, although not expressly provided for therein, to the provisions of Legislative Decree No. 206 of 6.09.2005. For any dispute between the parties regarding this contract, the Court of Turin (TO) (Italy) will be competent.
